Cancellation and Refund Policy
for Kuini Technologies Sdn. Bhd.
Welcome to Kuini Technologies Sdn Bhd (Registration No. 202601026252 (1688348-M)). Kuini designs and develops custom software solutions for clients across various industries, including healthcare centres, corporate secretarial firms, and other businesses. Terms and conditions stated below apply to all visitors and clients of https://kuini.io. You are bound by these terms and conditions as long as you engage with kuini.io or with Kuini’s services.
Scope of Services
This policy applies to all custom software development, IT consultancy, and related digital services provided by Kuini, including but not limited to bespoke software systems, web and mobile application development, system integration, and maintenance plans, for clients across industries such as healthcare centres, corporate secretarial firms, and other businesses.
Payments
Initial Payment:
A non-refundable initial payment (as agreed in the applicable proposal or service agreement, e.g. 50% of the total project cost) is required to begin any work. This payment covers initial consultation, project planning, and the reservation of our resources.
Balance Payment:
The remaining balance is due upon project completion and before the final software or service is launched or delivered to the client.
Cancellations
Cancellation by Client:
If a client requests to cancel a project before any work has commenced, the initial payment is forfeited and will not be refunded. If a client requests to cancel a project after work has started, all payments made up to the point of cancellation are non-refundable. The client will be invoiced for any additional work completed beyond the scope covered by the initial
payment. Any intellectual property created by Kuini remains our property until full payment is received.
Cancellation by Kuini:
We reserve the right to cancel a project at any time if a client breaches the agreed-upon contract terms, fails to provide necessary content, data, or feedback in a timely manner, or engages in unreasonable or abusive behaviour. In such cases, a prorated refund may be issued for uncompleted work, less any expenses and fees incurrd.
Refunds
Given the nature of software development services, which involve the investment of time and resources into intellectual property, we have a strict refund policy.
No Refunds After Work Has Commenced:
Refunds will not be issued for any project that has commenced, as our time and expertise have already been invested. The initial payment is non-refundable.
Exceptions:
A refund may be considered only in the event that Kuini fails to deliver the project as outlined in the initial agreement, and the client can demonstrate that we have not made reasonable efforts to remedy the situation. In such a case, the refund amount will be determined based on the percentage of work not completed, less any expenses and fees incurre.
Project Delays
We will not be held responsible for project delays caused by the client’s failure to provide necessary information, content, data, or feedback in a timely manner. Delays may impact project timelines and costs.
